These Terms of Service govern the use of getdear.com and purchases made from dear_.

By visiting the website, creating an order or purchasing a product, you agree to these Terms of Service, our Refund Policy, Shipping Policy and Privacy Policy.

1. The store

getdear.com is hosted through Shopify, which provides the ecommerce infrastructure used to display products, process orders and support checkout. Certain payments, shipping tools and other services may also be provided by third parties under their own terms and privacy practices.

2. Eligibility and account information

You must have the legal capacity required in your jurisdiction to place an order. When purchasing on behalf of another person or organization, you confirm that you have authority to do so.

You are responsible for providing accurate contact, billing, payment, shipping and personalization information. We may contact you when information is missing or when an order requires confirmation before production.

3. Products and handmade variations

dear_ jewelry is made and finished by hand in Mexico City. Small differences in surface, texture, polish, dimensions, weight and engraving placement may occur between pieces as a natural result of the making process.

These variations are not considered defects when they do not affect the material, function or essential design represented on the product page.

Product photographs are intended to represent the piece as accurately as possible. The appearance of metal, gemstones and finishes may vary according to lighting, screen settings and natural material variation.

4. Materials and gemstones

The material stated on each product page describes the composition offered for that piece, including 925 sterling silver or solid 14k gold where applicable.

Natural gemstones may vary in color, tone, inclusions, transparency and pattern. These characteristics are part of the material unless a specific quality or appearance has been expressly agreed in writing.

The customer should review the product description, dimensions, material and care information before purchasing.

5. Prices, currency and taxes

Prices may be shown in Mexican pesos or another available currency according to the customer’s market and store settings.

Prices displayed for orders shipped within Mexico include applicable Mexican taxes when indicated at checkout. International import duties, destination-country taxes, brokerage charges and similar amounts are not included unless checkout expressly states otherwise.

We may change product prices prospectively. A price change will not alter an order that has already been accepted and paid, except where the displayed amount resulted from an obvious technical or typographical error and applicable law permits the order to be corrected or cancelled.

6. Orders and acceptance

An order confirmation acknowledges that we have received the order. It does not necessarily mean that production has begun or that the order has been finally accepted.

We may contact the customer before accepting an order if material is unavailable, personalization details are incomplete, payment requires verification, the address cannot be serviced or the order appears to involve fraud, misuse or an obvious pricing error.

If we cannot fulfill an order and cancel it, amounts collected by dear_ for the cancelled item will be returned using the original payment method, subject to applicable law.

7. Personalization

The signature dear_ personalization may pair the word dear with a name or other customer-selected text inside the ring. Available characters, placement, length and typography may vary according to the design.

The customer is responsible for reviewing the exact spelling, capitalization, dates, symbols, ring size, gemstone selection and other instructions submitted with the order.

dear_ may reproduce the personalization exactly as entered and approved. We are not responsible for a customer error contained in the approved instructions.

We may decline text, imagery or requests that are unlawful, discriminatory, threatening, infringing, technically unsafe or incompatible with the design.

A piece is considered personalized or custom when it includes a customer-selected engraving, name, date, word, symbol, gemstone, non-standard size, altered dimension, modified finish or other requested alteration.

Once production or personalization has begun, changes and voluntary cancellations may no longer be possible. Personalized and custom pieces are not eligible for discretionary returns or exchanges, except where required by applicable law or when the piece is defective or differs materially from the approved order.

8. Ring sizing

dear_ uses standard US ring sizing unless a product page states otherwise.

The customer is responsible for selecting the correct size. Measurements taken at home are a guide and may be affected by finger shape, knuckle size, temperature and ring width.

An incorrect size selected by the customer is not a manufacturing defect. Personalized rings may not be eligible for return because of fit preference. A resize may be assessed when technically possible and may involve additional material, labor and shipping charges.

9. Payment

Payment must be authorized before an order can be accepted. The customer confirms that they are authorized to use the selected payment method and that the billing information is accurate.

A bank or payment provider may apply foreign transaction fees, currency-conversion charges, authorization holds or other amounts outside the control of dear_. These charges are not collected or refunded by dear_.

10. Production and shipping

Production estimates are displayed on product pages. They begin after payment and all required personalization details have been confirmed.

Production time and shipping transit time are separate. Delivery dates are estimates and may be affected by carrier operations, customs, weather, material availability and events outside our reasonable control.

Complimentary shipping does not include international import duties, destination-country taxes or brokerage fees unless checkout expressly states otherwise. The recipient is responsible for those amounts.

11. Returns, refunds and order problems

Return eligibility depends on the item, its condition, the time elapsed after delivery and whether it has been personalized or altered.

Non-personalized pieces may be eligible for return when the request is made within the period stated in our Refund Policy. Personalized and custom pieces are generally not eligible for discretionary returns or exchanges.

These restrictions do not apply when mandatory law provides otherwise or when a piece is defective, was made incorrectly by dear_ or differs materially from the approved order.

12. Care, wear and third-party work

Jewelry naturally develops signs of wear. Surface scratches, changes in polish and sterling silver tarnish can occur through ordinary use and are not necessarily manufacturing defects.

The customer should follow the care instructions provided by dear_. Damage caused by impact, pressure, chemicals, improper storage, misuse, loss, theft or work performed by another jeweler is not considered an error by dear_.

Repairs, resizing, refinishing, gemstone setting or engraving performed by a third party may prevent us from evaluating the original condition of a piece.

13. Website content and intellectual property

The website and its content, including the dear_ name, underscore mark, product names, jewelry designs, photographs, videos, text, illustrations, graphics, layouts and other original material, belong to dear_, Gerardo Muñiz or the applicable rights holder.

The content may not be copied, reproduced, modified, sold, distributed, commercially used or presented as another person’s work without prior written authorization.

Sharing a product page or social media post for personal, non-commercial purposes is permitted when the original source and brand are not removed or misrepresented.

14. Customer communications and submitted content

When you send a review, photograph, comment, design request or other material, you confirm that you have the right to provide it and that it does not violate another person’s rights.

We will not use private engraving text or personal order information in marketing without permission. If you separately authorize us to share a photograph, review or other content, that use will be governed by the permission granted.

15. Prohibited use

The website may not be used to commit fraud, interfere with store security, introduce malicious code, scrape content at scale, impersonate another person, infringe intellectual property or violate applicable law.

We may restrict access, decline an order or take appropriate action when we reasonably believe the website or checkout is being misused.

16. Third-party services and links

The website may include links or services operated by Shopify, payment providers, carriers, social networks or other third parties. dear_ does not control every aspect of those independent services.

Customers should review the applicable third-party terms and privacy practices. Nothing in this section limits responsibility that dear_ cannot legally exclude.

17. Accuracy and availability

We try to keep product descriptions, prices, availability, production estimates and website content accurate. Occasional technical, typographical or inventory errors may occur.

We may correct prospective website information and contact customers whose pending orders are affected. We will not use this provision to remove rights or obligations that have already arisen under applicable consumer law.

18. Limitation of liability

To the extent permitted by law, dear_ is not responsible for indirect losses caused by circumstances outside our reasonable control or by a customer’s misuse of a product or website.

Nothing in these Terms excludes liability for fraud, intentional misconduct, a product that does not match the specifications under which it was sold, or any responsibility or consumer right that cannot legally be waived.

19. Events outside reasonable control

We are not responsible for a delay caused by circumstances outside our reasonable control, including carrier interruption, customs action, natural event, public emergency, material shortage, power or network failure, labor disruption or government restriction.

When such an event affects an order, we will communicate available information and make reasonable efforts to complete, reschedule or otherwise resolve the order in accordance with applicable law.

20. Changes to these Terms

We may update these Terms to reflect changes in the store, services or applicable requirements. The current version and its effective date will be published on this page.

A later change will not retroactively alter the agreed terms of an order already placed unless required by law or accepted by the customer.

21. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

22. Governing law and consumer rights

These Terms are governed by the applicable laws of Mexico, without excluding any mandatory protection available to a customer in another jurisdiction.

We encourage customers to contact us first so that we can review and resolve a concern directly. Consumers may also seek assistance from the Procuraduría Federal del Consumidor or another competent authority.

Nothing in these Terms requires a consumer to waive protection under the Ley Federal de Protección al Consumidor or submit a claim exclusively to a foreign court.
